These disputes are between people or business. The most important object of Civil Law would be to solve disagreements and dispute between people by giving reimbursement to the aggrieved. The Civil Procedure Code governs the performance of civil rights and provides the process of civil legislation to be enforced.

“Civil law highlights more on dispute settlement than punishment.”

Civil law differs from criminal law; since the civil law highlights more on dispute settlement than punishment. Civil law is appropriate for wrongs against people, unlike criminal law that deals with wrongs perpetrated against the nation or society as a whole. The standard that has to be fulfilled in civil proceedings is”preponderance of chance” unlike criminal proceedings which derive from”beyond reasonable doubt.”

Civil law can be further subdivided into four categories:

Law of Torts: A tort is a civil wrong, performed by one individual or to a different, which leads to harm or property damage and financial reimbursement is provided to the injured party. So essentially tort involves personal injury and civil wrongdoing where a lawsuit for unliquidated harm is registered. There are 3 types of torts: neglect, intentional tort, and strict accountability.

Family Law: Family law is the branch of civil law that deals with marriage, divorce, child custody, adoption, etc and some other disputes and issues of households. Various religions have their personal laws in this respect, by way of instance, Hindu law, Muslim law, and Christian law, and Parsi law etc.. The instances relating to the law are dealt with by the family court rather than civil courts.

Contract Law: Contract Law in India is supplied under The Indian Contract Act, 1872 which deals with all sorts of contract, written or oral. The Indian Contract Act, 1872 includes provisions regarding the legitimacy of a contract, its own release and provides penalties for violation of their contract. To put it differently, contract law is the branch of civil law that addresses agreements between at least two parties and if a party violates all the stipulations of the contract, it’s called”breach of contract” a civil wrong.

Property Law: Property Law is the branch of civil law that handles all sorts of property, personal property or real estate/property, tangible or intangible, movable or immovable. Private property is a class of property which could incorporate any asset aside from real estate. Private property essentially is made up of movable property such as furniture, vehicles, jewellery etc.. This is real in nature.
