Terms & Conditions

1. Engagement & Scope

1.1 Kanoons Law & Tax Consultants Pvt. Ltd (“Service Provider”) provides consultancy services for GS1 barcode registration in India.
1.2 Final barcode allocation and approval authority rests solely with GS1 India.
1.3 Services include application filing, documentation support, and liaison with GS1 India.

2. Client Responsibilities

2.1 Client shall provide:

  • Accurate product information (names, variants, specifications)
  • Valid business registration documents
  • Timely responses to GS1 queries
    2.2 Client must ensure:
  • Barcodes are used only for registered products
  • Annual membership fees are paid directly to GS1 India

3. Fees & Payments

3.1 Quoted fees exclude:

  • GS1 India’s annual membership fees (₹15,000 for 100 barcodes)
  • Applicable GST (18%)
  • Additional charges for expedited processing (if any)

3.2 Payment schedule:

  • 60% advance with signed agreement
  • 40% balance before GS1 submission

3.3 No refunds for:

  • GS1 application rejections due to client-provided incorrect data
  • Services already initiated

4. Timeline & Deliverables

4.1 Standard processing: 7-10 working days post-document submission.
4.2 Delays may occur due to:

  • GS1 India’s internal processing
  • Client’s delay in providing documents
  • Government holidays/notifications

5. Barcode Usage

5.1 Allocated barcodes are:

  • Non-transferable to other businesses
  • Valid only with active GS1 membership
    5.2 Misuse (e.g., duplicate barcodes) may lead to:
  • GS1 blacklisting
  • Legal action under Consumer Protection Act, 2019

6. Intellectual Property

6.1 GS1 retains ownership of all barcode numbers.
6.2 Kanoons-provided templates (e.g., application forms) are for single-use only.

7. Liability

7.1 Service Provider is not responsible for:

  • GS1 India’s approval/rejection decisions
  • Barcode scanning failures due to printing errors
  • Client’s non-compliance with GS1 usage guidelines

7.2 Maximum liability limited to fees paid for consultancy services.

8. Confidentiality

8.1 Client data protected under:

  • Information Technology Act, 2000
  • GS1 India’s data policies
    8.2 Product details are shared with GS1 India only for registration purposes.

9. Termination

9.1 Either party may terminate with 15 days written notice.
9.2 Post-termination:

  • Client remains liable for GS1 fees
  • Kanoons will transfer all GS1 communications to client

10. Governing Law & Dispute Resolution

10.1 Agreement governed by Indian laws with exclusive jurisdiction in Hyderabad, Telangana.
10.2 Disputes resolved through:

  • Mediation (Hyderabad Mediation Centre)
  • Arbitration (Hyderabad International Arbitration Centre) if unresolved

11. Force Majeure

Not liable for delays caused by:

  • GS1 India server/technical failures
  • Government policy changes
  • Natural disasters

12. General Clauses

12.1 Entire agreement supersedes prior communications.
12.2 Amendments require written consent from both parties.
12.3 If any clause is invalid, remainder remains enforceable.
